General Terms and Conditions of Sale of the website www.francine-bramli.com (hereinafter the "Website")
The company CREOLES is the owner of the Francine Bramli Paris trademark.
Article 1: Scope of Application
These general terms and conditions of sale (GTC) apply exclusively to all sales of products concluded between the company CREOLES (simplified joint-stock company, SIRET: 45092020200055, hereinafter "Francine Bramli Paris") and non-professional consumers via the Website, hereinafter referred to as the "Customer(s)."
These GTC do not apply to professionals purchasing in the course of their professional activities, wholesalers, or distributors.
"Products" refers to all products sold via the Website.
"Francine Bramli Paris Address" refers to the postal address of the company CREOLES, namely 159 rue du temple, 75003 Paris, France.
All information about the company CREOLES can be found here.
The Website delivers to all countries worldwide.
Placing an order implies the Customer's full and unreserved acceptance of these GTC, to the exclusion of all other documents such as catalogues, brochures, etc. issued by Francine Bramli Paris, which are for informational purposes only. Any conflicting terms put forward by the Customer shall, in the absence of express acceptance by Francine Bramli Paris, be unenforceable against Francine Bramli Paris, regardless of when they may have come to its attention. The Customer may freely consult these GTC at any time by clicking on the "General Terms and Conditions of Sale" link at the bottom of each page of the Website. Francine Bramli Paris reserves the right to modify these GTC at any time.
Article 2: Order Placement
2.1 The Customer places their order in accordance with the process in effect on the Website, as follows:
Step 1: Choice of model, clasp, and desired quantity.
Step 2: In the "cart" section, you may change quantities, remove Products, continue shopping, add a promotional code, choose your delivery method (home delivery or in-store pickup), and confirm your order to proceed to the page where you enter your details.
Step 3: After entering your delivery address, you will have the option to save your details for a future order. The Customer is required to provide honest and accurate information.
Step 4: Choice of delivery method: the delivery time and cost are indicated next to each available delivery option. However, delivery times are indicative only and Francine Bramli is not responsible for any delays caused by a third-party delivery provider. For further details, please refer to Article 7.
If you do not have a letterbox, are rarely at home, regularly have mail stolen, or require your parcel to arrive on a specific date, please avoid selecting La Poste and contact us at serviceclient@francinebramliparis.com to choose the best option.
An email will be sent to you no later than the next working day following your order to inform you that your order is ready. You will then have 14 (fourteen) days to collect your order. After this period, your order will be cancelled and refunded.
Step 5: Choice of payment method: Apple Pay, PayPal, or credit/debit card. You must select your billing address (which may be the same as your delivery address).
You must read and approve the "General Terms and Conditions of Sale" (by checking the box) before proceeding to payment.
Your order is only confirmed once payment has been made. Prior to payment, you may modify or cancel your order. After payment, please contact us with any queries at serviceclient@francinebramliparis.com or by phone at +33 (0)6 70 61 01 68.
Article 3: Order Confirmation
3.1 Once your order has been finalized, you will receive a confirmation email.
3.2 Francine Bramli reserves the right not to confirm an order for any reason, including supply issues or a problem with the order received. In any case, the Customer will be informed as soon as possible by Francine Bramli Paris, who will offer a replacement or refund.
Products are offered for sale while stocks last.
Article 4: Prices – Invoice
Prices are stated in euros inclusive of all taxes (VAT included). The price guaranteed to the Customer is that displayed on the Website at the time the Product is added to the cart. This price is fixed, final, and non-negotiable; it includes preparation costs but not delivery costs. Prices reflect the VAT rate applicable on the date of the order and are therefore displayed inclusive of VAT.
Any change in the applicable VAT rate may be reflected in the selling price of the Products in the catalogue.
For deliveries outside the European Union, the Customer will be required to pay customs duties, VAT, or other taxes due on the importation of the Products into the country of delivery. The related formalities are also the sole responsibility of the Customer, unless otherwise stated. The Customer is solely responsible for verifying the import conditions applicable to the ordered Products under the laws of the delivery country.
The total shown at the end of the order summary includes delivery costs and VAT.
An invoice will be included in the parcel.
Article 5: Payment
The accepted payment methods are indicated at the bottom of the website (logos).
The Customer agrees to pay the total price stated in the order summary and, where applicable, to pay or arrange payment of customs duties, VAT, or other taxes due on importation of the Products into the country of delivery, directly to the freight forwarder or carrier.
The Customer pays for their order in full (no partial payments accepted) by Apple Pay, PayPal, or credit/debit card as offered on the Website.
Before proceeding to payment, the Customer confirms their unreserved acceptance of these GTC as they stand on the date of their order, having read them in advance.
Payment of the order constitutes an irrevocable commitment by the Customer, which may only be called into question in the limited cases provided for in these GTC under the "Right of Withdrawal" and "Warranties" articles.
Article 6: Payment Security
For the security of your payments, Francine Bramli uses Shopify Payments, an online platform enabling Francine Bramli to accept payments. This platform complies with the strictest certification standards to guarantee the security of payments made on the website (Level 1 PCI DSS certification; SSAE18/SOC 1 Type 1 and 2 and SSAE18/SOC 2 Type 1 and 2 reports; compliant with European PSD2 directive and strong customer authentication).
Article 7: Delivery
7.1 Products are delivered to the address indicated by the Customer on the form entitled "Information."
7.2 The order will be processed within an average of 6 working days following the date of payment, subject to the availability of the ordered Product and unless a specific agreement has been reached between both parties.
The Customer expressly acknowledges that the delivery period may be extended by 5 days for deliveries outside metropolitan France and by 10 days for deliveries outside the EU.
Delivery times are given as an indication only and cannot engage the liability of Francine Bramli Paris. In the event of a stock shortage or unavailability of the ordered Product, Francine Bramli undertakes to inform the Customer as soon as possible and to specify an availability timeframe or arrange a refund, to the exclusion of any damages.
A delivery delay shall not give rise to any withholding, penalty, compensation, or indemnification.
7.3 If, 30 (thirty) days after the order, the Product has not been delivered for any reason other than force majeure, the product may be replaced or the sale may be cancelled at the request of either party by registered letter with acknowledgment of receipt, to the exclusion of any damages. The following are considered force majeure events releasing Francine Bramli Paris from its delivery obligation: war, riot, fire, strikes, epidemics, accidents, regulations or requirements of public authorities, or any other unavoidable, unforeseeable event beyond the control of Francine Bramli Paris. Francine Bramli Paris will keep the Customer informed, in a timely manner, of the cases and events listed above.
Francine Bramli Paris will refund the Customer the full amount paid no later than 14 (fourteen) days following the date on which the contract was terminated.
7.4 Upon delivery, the Customer must verify the contents, conformity, and condition of the Product(s). In the event of a problem, the Customer must follow the claims procedure referred to in Articles 9 and 10 below.
Article 8: Personal Data
As data controller, the company CREOLES processes certain personal data electronically. The company CREOLES undertakes to comply with the French Data Protection Act ("Loi Informatique et Libertés," Law of January 6, 1978, as amended).

Article 9: Right of Withdrawal (Delivery or Click & Collect)
The Customer has a period of 14 (fourteen) calendar days from receipt of their order to notify Francine Bramli Paris of their wish to exercise their right of withdrawal. The Customer is informed that the return of the Product(s) will be at their own expense, for exchange or refund, in accordance with Article L 212-21-3 of the French Consumer Code. If this deadline falls on a Saturday, Sunday, or a public holiday, it is extended to the next working day.
In the event of the purchase of several Products in a single order delivered separately, the withdrawal period begins on the day the Customer takes physical possession of the last Product.
The notification of the exercise of the right of return may be made by email at serviceclient@francinebramliparis.com or by registered letter. The Customer may use the following text:

Francine Bramli Paris will acknowledge receipt of the Customer's request.
After notifying Francine Bramli Paris of their wish to exercise the right of withdrawal, the Customer has 14 (fourteen) days to return the Product (including the pouch) by post in its original condition and packaging to the Francine Bramli Paris Address.
The Product must not have been used or worn, must not have sustained any damage however minor, and must be in perfect condition. This right of withdrawal is exercised without penalty, with the exception of return shipping costs, which remain the Customer's responsibility.
Within a maximum period of 14 (fourteen) days from receipt of the Product at the Francine Bramli Paris Address, the Customer will be refunded the amounts paid.
Article 10: Warranties
For jewellery made with natural materials, the stone and its colours may vary from one piece to another.
10.1 Francine Bramli provides no warranty for apparent defects detectable upon normal examination of the Product that may affect the delivered Product and have not been reported by the Customer under the conditions set out below.
The Customer remains liable for any depreciation of the Products resulting from handling beyond what is necessary for normal use.
10.2 Legal warranty of conformity:
The legal warranty of conformity covers conformity defects in the Product and its packaging in the following situations:
- The item is unfit for the purpose normally expected of a similar item,
- The item does not match the description given by the seller,
- The item does not possess the qualities announced by the seller or agreed upon with the Customer.
To benefit from the legal warranty of conformity, the defect must have existed at the time of purchase. The Customer is not required to prove the existence of the conformity defect during the 24 months following delivery of the Product. If the defect appears more than 24 months after purchase, the Customer may not benefit from the conformity warranty unless they can prove that the defect existed at the time of purchase.
Francine Bramli Paris will request the return of the Product in order to carry out an expert assessment.
In the event of a conformity defect, the Customer may choose between repair and replacement of the Product.
However, Francine Bramli Paris may decline to proceed according to the Customer's choice if it would entail a manifestly disproportionate cost compared to the other option, taking into account the value of the item or the significance of the defect. In such case, Francine Bramli Paris is required to proceed, where possible, according to the other option.
If repair and replacement of the Product are both impossible, the Customer may return the Product and receive a full refund, or keep the Product and receive a partial refund. However, cancellation of the sale cannot be ordered if the conformity defect is minor.
The Customer has a period of 2 (two) years to return the Product to Francine Bramli Paris, enclosing with their return (i) an explanatory letter describing the issue and indicating the date the non-conformity was discovered, (ii) the delivery note, and (iii) the invoice.
10.3 In accordance with Article 1641 of the French Civil Code, Francine Bramli Paris is also bound by the legal warranty against hidden defects.
To invoke the warranty against hidden defects, the Product defect must meet the following 3 conditions:
- Be hidden, i.e. not apparent at the time of purchase,
- Render the item unfit for its intended use, or significantly diminish its use,
- Have existed at the time of purchase.
It is the Customer's responsibility to prove the existence of a hidden defect.
The Customer has a period of 2 (two) years to return the Product to Francine Bramli Paris, enclosing with their return (i) an explanatory letter describing the issue and indicating the date the hidden defect was discovered, (ii) evidence of the existence of the hidden defect, (iii) the delivery note, and (iv) the invoice.
Francine Bramli Paris will carry out an expert assessment of the Product upon receipt.
If Francine Bramli Paris considers that the warranty against hidden defects is applicable, it will refund the price of the Product as shown on the purchase invoice, within a timeframe that allows it to first carry out an expert assessment of the Product.
Article 11: Contract Formation and Evidence
The "validation click" on "pay now" constitutes proof of the formation of the sales contract. This electronic validation between the parties carries the same legal weight as a handwritten signature. Clicking the box confirming acceptance of the general terms and conditions of sale also constitutes proof of unreserved acceptance of these GTC.
These GTC exist in French only; by proceeding, you declare that you understand French and all the provisions of these GTC.
It is recommended that you print and retain a copy.
Computerized records kept in the computer systems of Francine Bramli Paris under reasonable security conditions will be considered as proof of communications, orders, and payments between the parties.
Orders and invoices are archived on a reliable and durable medium that may be produced as evidence.
Article 12: Photos
The essential characteristics of Francine Bramli Paris Products are described alongside one or more photographs which, despite all precautions taken by Francine Bramli Paris, may show minor differences from the item on sale due to the shooting distance, photo processing, or the method of data transmission and display on screen. Francine Bramli Paris cannot be held responsible for such differences.
Article 13: Intellectual Property
Francine Bramli Paris holds the intellectual property rights to the Website and the right to distribute the elements featured in the Website catalogue — including photographs for which Francine Bramli Paris has obtained the necessary authorizations from the relevant parties, or of which Francine Bramli Paris is the author. Accordingly, any total or partial reproduction of the Website and all elements it contains is strictly prohibited.
Any reproduction or use of the Website's elements would constitute a breach of intellectual and industrial property regulations.
The Products themselves, as original creations, are also protected by national and international copyright provisions.
Francine Bramli Paris reserves the right to take legal action against any person who infringes its rights or these general terms and conditions.
Article 14: Security
Francine Bramli Paris undertakes to ensure the operation of the Website so as to enable optimal use under the conditions defined in these general terms and conditions.
Francine Bramli Paris undertakes to implement technical and organizational measures in line with industry standards to protect your data.
The service may occasionally be suspended due to maintenance work necessary for the proper functioning of the Website.
Francine Bramli Paris cannot be held liable in the event of Website malfunction due to maintenance, technical issues, inability to access the Website, or failures of the hosting server or internet service providers.
Article 15: Final Provisions
These general terms and conditions of sale express the entirety of the parties' obligations. No other general or specific terms communicated by the Customer may be incorporated into or override these general terms and conditions.
The fact that Francine Bramli Paris does not invoke any provision of these GTC at any given time shall not be construed as a waiver of the right to invoke said provision at a later date.
The Website contains hyperlinks to partner websites. Should the user visit any partner websites, Francine Bramli Paris disclaims all responsibility for access to, content of, and use of such websites, and for any damages that may result.
Article 16: Disputes
We are confident that our customer service team, reachable at 01 42 71 81 48, will be able to assist you in the event of any issue.
Nevertheless, and in accordance with Article L.133-4 of the French Consumer Code, the Customer is informed of the possibility of resorting, free of charge, to a conventional mediation procedure in the event of a dispute.
